APPROVAL OF TERMS
These Terms of Use ("Agreement") are the terms and conditions for your use of the website www.BLUEJobs247.com ("Website"), the mobile application "BLUE Jobs 247" ("Application"), and any other related products and services (collectively referred to as the "Service"). This Agreement is a legally binding agreement between you ("User," "Partner," "Customer," "you" or "your") and the operator of the Website and developer of the Application ("BLUE Jobs," "Operator," "we" or "our"). If you are entering into this agreement on behalf of a business or legal entity, you represent that you have the authority to bind that legal entity to this agreement in the case of "Customer" or "Partner" being such legal entity. If you do not have the authority to bind a legal entity or if you do not agree to the terms of this agreement, do not accept this agreement and do not access and use the Service. By accessing and using the Service, you acknowledge that you have read, understood, and agree to be bound by the terms of this Agreement. You acknowledge that this Agreement is a contract between you and BLUE Jobs, although it is an electronic contract and does not have a physical signature, and it governs your use of the Service.
BLUE Jobs is a technology application providing a recruitment and job search support platform in all fields and job specialties, including office jobs, manufacturing plant jobs, freelancing, part-time jobs, and the provision of utility services. The role of BLUE Jobs is to connect Customers with Partners. BLUE Jobs is not responsible for the actions and/or omissions of any Partner, and any legal responsibilities related to job services must be borne by the Partner. Partners are not agents, employees, or workers of BLUE Jobs, and the solutions provided by Partners are not considered to be provided by BLUE Jobs.
DEFINITIONS
In these Terms of Use, the following terms shall have the meanings described below:
• "Application" means the mobile application provided by BLUE Jobs for Customers and Partners to download;
• "BLUE Jobs Policies" include: Privacy Policy; Partner Code of Conduct and Customer Code of Conduct, which may be applicable; and all forms, policies, notices, guidelines, frequently asked questions (FAQs), or agreements provided or executed by you from time to time.
• "Platform" means the technology platform, portal, or related website of BLUE Jobs, when used in conjunction with the Application, that allows Users to request or use the Services;
• "Service" means the connection of Partners with Customers through the Website, Application, Platform, and/or Software of BLUE Jobs;
• "Software" means any software associated with the Application provided for downloading and installation by BLUE Jobs;
• "Partner" means independent third parties providing job services to Customers through the BLUE Jobs Service, including full-time, part-time, utility service, and casual labor service providers;
• "Customer" means an individual or business entity desiring to seek and receive job services from Partners;
• "User" means anyone using the Application, Platform, and/or Software of BLUE Jobs, including Partners and Customers.
USER ACCOUNT
To utilize most aspects of the Service, you must register and maintain an active User account ("Account"). You must be at least 18 years old or of legal age in your jurisdiction (if different from 18) to use the Service. By using the Service and agreeing to this Agreement, you represent and warrant that you are at least 18 years old.
If you create an Account, you are responsible for maintaining the security of your account and are fully responsible for all activities that occur under the account and any other actions taken in relation to that account. We may monitor and review new accounts before you can log in and start using the Service.
ACCOUNT REGISTRATION
To register for an Account, we require you to provide BLUE Jobs with certain personal information, including but not limited to, your name, date of birth, address, mobile phone number, and email. You agree to maintain accurate, complete, and up-to-date information in your account. Providing incorrect contact information in any form may result in termination of your account. You must promptly notify us of any unauthorized use of your account or any other security breaches. We will not be liable for any actions or omissions, including any damages arising from the consequences of such actions or omissions. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any terms of this Agreement or if your conduct tends to harm our reputation and goodwill. If we delete your account for the reasons mentioned above, you may not re-register for our Service. We may block your email address and Internet protocol address to prevent further registration.
ACCOUNT CATEGORIZATION
After registering for an Account, you may add an account type to use the Website/Application and the services provided by the Website/Application as either a Customer or a Partner, using the same username and password. For example, if you already have a Partner Account, you can add a Customer Account as a separate account type within the settings without the need for re-registration.
TEXT MESSAGES
By creating an Account, you agree that BLUE Jobs may send you text messages (SMS) as part of using the Services. You may choose not to receive text messages at any time by sending an email to the specified system email stating that you no longer wish to receive such messages, along with the phone number registered for receiving text messages. You acknowledge that choosing not to receive text messages may affect your use of the Services.
USER-PROVIDED CONTENT
We do not own any audio and/or visual data, information, or materials (collectively referred to as "Content") that you submit, upload, publicly post, or provide to BLUE Jobs during the use of the Services. You are solely responsible for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property rights or usage rights of all the Content you submit. You grant us the right to monitor, review, copy, distribute, store, transmit, reformat, and display the Content of your user account for the purpose of providing the Services to you. Notwithstanding any statements or warranties, we reserve the right to refuse or delete any Content that, in our reasonable opinion, violates any of our policies or is otherwise harmful in any way. You also grant us a license to use, reproduce, modify, adapt, publish, or distribute the Content created or stored in your user account for commercial, marketing, or any similar purposes.
BACKUP
We regularly perform backups of the Website/Application and its Content and will make every effort to ensure the completeness and accuracy of these backups. In the event of hardware failure or data loss, we will restore the backups automatically to minimize the impact and downtime of the Website/Application.
LINKS TO OTHER SOURCES
Although the Services may link to other resources (such as websites, mobile applications, etc.), we do not directly or indirectly imply any endorsement, cooperation, sponsorship, advertising, or affiliation with any linked sources unless specifically stated here. Some links on the Services may be "affiliate links." This means that if you click on the link and purchase an item, BLUE Jobs will receive a commission from the affiliate. We do not take any responsibility for reviewing or evaluating any individuals or businesses or their content. We do not assume any liability or legal obligation for the actions, products, services, and content of any other third parties. You should carefully review the legal statements and other terms of use of any source that you access through links on the Services. Your linking to any other external websites is at your own risk.
PROHIBITED USE OF SERVICES
In addition to other terms specified in the Agreement, you are prohibited from using the Services or Content: (a) for any unlawful purposes; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any regulations, rules, laws, or ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to transmit false or misleading information; (g) to upload or transmit viruses or any other harmful type of code that may affect the functionality or operation of the Services, third-party products, or the Internet; (h) to send spam, engage in spoofing, scraping, or data mining; (i) for any pornographic or unethical purposes; or (j) to interfere with or disrupt the security features of the Services, third-party products, or the Internet. We reserve the right to terminate your use of the Services for any violation of prohibited uses.
INTELLECTUAL PROPERTY RIGHTS
"Intellectual Property Rights" means all current and future rights conferred by statute, common law, or any relevant regulatory body in relation to any copyright and related rights, trademarks, designs, patents, inventions, goodwill, and rights to sue for passing off, rights in inventions, rights to use, and all other intellectual property rights, in each case, whether registered or unregistered and including all applications and rights to apply for and be granted, rights to claim priority, those rights and all similar or equivalent rights or forms of protection and any other results of intellectual activity which exist or will exist now or in the future in any part of the world. This Agreement does not transfer to you any intellectual property owned by BLUE Jobs or third parties, and all rights, titles, and interests in and to such property will remain solely (as between the parties) with BLUE Jobs. All trademarks, service marks, graphics, and logos used in connection with the Services are trademarks or registered trademarks of BLUE Jobs or its licensors. Other trademarks, service marks, graphics, and logos used in connection with the Services may be the trademarks of other third parties. Your use of the Services does not grant you any right or license to reproduce or use any BLUE Jobs or third-party trademarks.
FEES AND PAYMENTS
Membership Fee
Users pay a fee (referred to as "Membership Fee") for using the job connection features on the BLUE Jobs website and application. This fee is charged annually and is non-refundable under any circumstances.
Service Fee
Customers pay BLUE Jobs a fee (referred to as "Service Fee") for each confirmed job transaction on the BLUE Jobs website and application. Depending on the limits prescribed by current laws, the Service Fee will be a percentage of the Order value, determined by BLUE Jobs at each specific time.
Users need to register a valid credit/debit/ATM card ("Card") as specified on the Application. Users agree that BLUE Jobs may verify and accept User's Card information when using BLUE Jobs' services.
The Membership Fee and Service Fee (collectively referred to as "Fees") paid by Users are non-refundable, unless otherwise determined by BLUE Jobs in writing. BLUE Jobs will respond to any requests from Partners or Customers to change the Fee for a specific service. After payment confirmation, BLUE Jobs will send the User an invoice via email, provided that the User's email has been authenticated on the Application.
BLUE Jobs reserves the right to establish, remove, and/or modify Fees for any or all services received through the use of the Service at any time. BLUE Jobs will make reasonable efforts to notify Users of applicable fees, provided that Users will be responsible for any Fees incurred to their Account, whether or not the User is aware of such Fees or the associated amounts. At any given time, BLUE Jobs may provide Users with certain promotional programs and discounts that may result in different fee calculations for the same or similar services received through the use of these services. Users agree that such promotional discount programs will not be related to Users' use of the services or Fees applicable to Users, unless provided to the User.
Any statements made by BLUE Jobs (on the BLUE Jobs website, in the Application, or in BLUE Jobs' marketing materials) stating that tipping is "voluntary," "non-obligatory," and/or "included" in Customer's payment for the services provided, do not imply that BLUE Jobs will provide any additional amounts, beyond those described above, to Partners. Partners understand and agree that when Customers voluntarily provide additional payment as a tip for any Partner providing services to the Customer through this Service, the Customer is not obligated to do so. Tips are voluntary.
BLUE Jobs may temporarily suspend the processing of any transactions or disable or limit the use of the Card in the event of any error in a transaction resulting in denial or reimbursement from a financial institution or when BLUE Jobs, reasonably believes, the Card has been used for a fraudulent transaction, an illegal activity, or is in violation of the Contract. Users agree to cooperate in financial crime screening measures as required and assist BLUE Jobs in complying with applicable regulations. Users are responsible for resolving disputes with the Card issuer.
Refunds and Transaction Cancellations
The Membership Fee will not be refunded under any circumstances, including canceling membership before the one-year term.
If the Customer/Partner wishes to cancel a transaction before paying the Service Fee to BLUE Jobs, the Customer/Partner must select "Terminate Contract" on the Application, and the system will automatically record the canceled transaction. In the case where the Customer has completed payment of the Service Fee to BLUE Jobs, the system will record the completed transaction, and the User can proceed with new transactions.
PLEDGE, GUARANTEE, AND COMMITMENT
By using the services of BLUE Jobs, you pledge and guarantee:
• You agree to immediately notify us of any unauthorized use of your account or any other security breach.
• You will not attempt to disrupt or harm the Service, Application, and/or Software in any form.
• You will not attempt to commercially exploit any part of the Application without our permission, including but not limited to modifying any content of the Application in any way, or copying, reproducing, publicly displaying, distributing, or using or transmitting for any public or commercial purpose without our permission.
• You will not allow others to use your identity or user status, and you will not transfer or assign your user account to any individual or organization.
• You will not use the Application to send and store any illegal materials or fraudulent purposes.
• You will not copy or distribute the Software or other content without written permission from BLUE Jobs.
• You agree that the Service may be affected by certain external factors (network transmission, peak hours, weather effects, etc.) that may result in the quality and availability of the Service not being guaranteed throughout. BLUE Jobs will make its best efforts to provide the Service to you.
• You agree to cooperate with BLUE Jobs in any internal or external investigation that BLUE Jobs may request to comply with laws or regulations.
• You fully accept responsibility and obligation for any loss or damage caused to yourself, BLUE Jobs, or any third party as a result of your violation of this Contract, not caused by the fault of BLUE Jobs or that third party.
• You agree not to use devices or applications that have been modified with the intention of avoiding detection or supporting fraudulent activities with BLUE Jobs or to disrupt the inherent features of the Application.
If you are a Partner, you additionally pledge, guarantee, and commit:
• You will fully assume responsibility for any and all complaints, judgments, and legal obligations arising from any accidents, losses, or damages, including but not limited to personal injury, death, total loss, and property damage caused by or alleged to be caused by the employment services provided by you.
• You must comply with all local laws relating to the provision of employment services and will be responsible for any violation of local laws.
• You will not contact Customers for purposes unrelated to the Service and employment services.
• You are not allowed to query, monitor, or attempt to monitor any information about any other users or visitors to the Application or any other customers of BLUE Jobs, including any user accounts that are not owned by you, from or through the Application's sources or exploits or any available or provided services or information by or through the Application in any way for the purpose of disclosing any information, including but not limited to personal identification information, other than your own information as provided by the Application.
• You agree that you are prohibited from offering any form of discounts or other discount proposals to Customers. You are strictly prohibited from using the Service for purposes other than, for example, exploiting BLUE Jobs' data information or information related to the Application or Service. Violation of this will constitute a serious violation and may be considered industrial espionage or destructive behavior. BLUE Jobs reserves the right to take appropriate or permitted actions under the law to counteract you and/or any person, whether natural or artificial, directing or instructing you, in the event you use the Service for purposes other than its intended use.
If you are a Customer, you additionally pledge, guarantee, and commit:
• You will comply with BLUE Jobs' Policies.
• You will not use the Application, Platform, and/or Software to annoy, harass, disturb, or engage in fraudulent job placement services.
• You will not intentionally or unintentionally cause or attempt to cause harm to the Partner.
DISCLAIMER
Any views or opinions expressed on the Service are solely those of the content creators and do not represent the views or opinions of BLUE Jobs. Any views or opinions are not intended to malign any religion, ethnic group, club, organization, company, or individual.
The reviews and opinions are received through various forms of submission. The reviews and opinions may not necessarily represent the views of all users of the Service, and BLUE Jobs is not responsible for any opinions or comments posted. Reviewers may have received compensation in the form of free products or discounts for their experiences. All contributions are the individual opinions of the reviewers.
Some reviews may have been edited for clarity or brevity, in cases where the original review included unrelated information. Reviews may be evaluated for authenticity before they are displayed to the public.

LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, in no event shall BLUE Jobs, its affiliates, directors, officers, employees, collaborators, agents, suppliers, or licensors be liable to any person for any indirect, incidental, special, or consequential damages (including, without limitation, damages for loss of profits, revenue, sales, business opportunities, use of content, impact on business, business interruption, or loss of business information) arising out of any legal theory of liability, even if advised of the possibility of such damages or could have foreseen such damages.
COMPENSATION
You agree to indemnify and hold harmless BLUE Jobs and its affiliates, directors, officers, employees, collaborators, agents, suppliers, and licensors from and against any and all legal responsibilities, losses, damages, or expenses, including reasonable attorney's fees, arising out of or resulting from any allegations, complaints, actions, disputes, or demands asserted by any third party arising from or related to your Content, your use of the Service, or any intentional misconduct on your part.
DISPUTE RESOLUTION
The formation, interpretation, and performance of this Agreement and any disputes arising out of this Agreement shall be governed by the substantive laws and procedures of United States, without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of United States. The exclusive jurisdiction and venue for actions related to disputes and the resolution of disputes shall be the courts located in United States, and you submit to the personal jurisdiction of those courts. Accordingly, you waive any right to a jury trial in any proceeding arising out of or related to this Agreement.
CHANGES AND MODIFICATIONS
We reserve the right to modify this Agreement or its terms relating to the Service at any time, at our sole discretion. When we do, we will revise the updated date at the bottom of this page, send an email notification to you, or provide other means of notice as we deem appropriate, such as through the contact information you have provided. The updated version of this Agreement will be effective immediately upon posting the revised Agreement unless otherwise specified. Your continued use of the Service after the effective date of the revised Agreement (or other action specified at that time) constitutes your consent to the changes.
